INJURED AT WORK
We handle all workers’ compensation cases. Since we only represent the injured employees and never the employers, we will always be focused on your best interests and tirelessly pursue the maximum benefits you and your family deserve.
Anytime you’re hurt on the job or became sick as a result of work, Workers’ Compensation Insurance is responsible for paying the following benefits:
-
Lost wages
-
Cash award for any permanent damage that partially or totally effects your ability to work (this cash award is not taxable)
-
Death benefit including funeral expenses and wage loss payments to your family
Do You Need to Prove Fault to Collect Benefits?
NO, you do not need to prove fault. In fact, you can be at fault and still receive workers’ comp benefits. You are entitled to benefits regardless of who is at fault.
Also, if your a paid or volunteer Police Officer, Fire Fighter, Correction Officer, EMS, Medical Technician, Nurse, etc.) there is a presumption of compensability if you can demonstrate exposure at work.
Should I File a Claim for only Serious Injuries?
NO, you should file a Claim for any and all injuries. Some injuries may take months or years to show permanent damage and, without a record of it occurring, it could be difficult to prove it happened at work.
Besides Workers’ Comp, Is Other Legal Remedies Available?
Depending on how your injury happened, other negligent parties may be liable for your injuries and a separate lawsuit could be filed against them for your medical expenses, lost wages, and pain & suffering.
The Law Office of Mario DiRienzo will assess your case and pursue all possible avenues of compensation in an efficient and timely manner.
Is There a Time Limit to File?
YES, a workers’ comp claim must be filed within 2 years of date of injury or last payment of compensation, whichever is later.
If the injury is a work-related disease or occupational illness (such as toxic exposure) the claim must be filed within 2 years of when the worker became aware of the condition and its link to employment.
